Terms of Service

These Terms of Service ("Terms") are an agreement between you and Sortwell ("Sortwell," "we," "us," or "our") and govern your access to and use of the Sortwell website, application, and services (together, the "Service"). By creating an account, connecting a Gmail inbox, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Sortwell organizes a connected Gmail inbox by filing receipts, sweeping newsletters and notifications, flagging real mail, and learning from how you file. By design, Sortwell only adds and removes Gmail labels: it never permanently deletes mail and never sends, replies to, or forwards mail, and every action it takes is logged and reversible. Sortwell is a working name for a product currently in private beta; features may change as the product develops.
2. Eligibility & accounts
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the activity under your account and for keeping your access credentials secure. You agree to provide accurate information and to keep it up to date. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
3. Google connection
The Service works by connecting to your Gmail account through Google's OAuth flow. Your use of Gmail and other Google services remains subject to Google's own terms. You can revoke Sortwell's access at any time from your Google Account permissions; doing so will stop the Service from functioning. Our handling of Google user data is described in our Privacy Policy and Limited-use policy. Sortwell is not affiliated with, sponsored by, or endorsed by Google.
4. Acceptable use
You agree not to:
- connect a mailbox you are not authorized to access, or use the Service to access another person's data without permission;
- use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
- attempt to probe, scan, disrupt, overload, or breach the Service or its infrastructure, or circumvent its limits or security;
- reverse engineer, copy, resell, or create derivative works of the Service except as permitted by law;
- use the Service in violation of Google's policies, applicable law, or any third party's rights.
5. Plans, billing & cancellation
Sortwell offers a free trial and paid subscription plans. Specific prices, plan features, and trial length are shown on our pricing page and may change; current pricing is being finalized.
- Trial. The free trial runs for the period stated at sign-up and requires no payment to start. If you do not subscribe by the end of the trial, paid features stop.
- Subscriptions. Paid plans are billed in advance on a recurring basis (monthly or annually, as you choose) and renew automatically until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on each renewal.
- Cancellation. You can cancel at any time from within your account. Cancellation stops future renewals; your plan remains active until the end of the current paid period, after which it will not renew.
- Refunds. Except where required by law, payments are non-refundable and there are no refunds or credits for partial periods. [Owner to confirm refund policy and any applicable consumer-protection terms for your jurisdiction.]
- Taxes & price changes. Prices exclude taxes unless stated; you are responsible for applicable taxes. We may change prices with reasonable advance notice, effective on your next renewal.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what data we access, how we use and protect it, and the controls you have. By using the Service you acknowledge that policy.
7. Intellectual property
The Service, including its software, design, and content (excluding your data), is owned by Sortwell and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You retain all rights to your own data; you grant us only the limited rights needed to operate and provide the Service to you.
8. Third-party services
The Service relies on third-party providers (including Google, Vercel, Neon, and Anthropic) to function, as described in our Privacy Policy. We are not responsible for the availability, acts, or omissions of third-party services, and your use of them may be subject to their own terms.
9. Disclaimer: the Service is provided "as is"
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or perfectly accurate, or that every message will be classified the way you would. Because email classification involves automated and AI-assisted judgment, mistakes can happen; the Service is designed to be conservative (leaving uncertain mail in your inbox) and reversible (every action can be undone), but you remain responsible for reviewing your own mail. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Sortwell and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Sortwell and its owners and operators from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required to protect the Service or other users, or if required by law. On termination, your right to use the Service ends; provisions that by their nature should survive (such as the disclaimer, liability limits, and indemnity) will survive. Deletion of your account and data is handled as described in the Privacy Policy.
13. Changes to the Service or Terms
We may modify or discontinue features of the Service, and we may update these Terms from time to time. When changes are material, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
